An efficient System of investment protection, either through legislation or through Bilateral Investment Treaties (BIT's), is indispensable.

Expeditiously resolving litigation relating to investments through arbitration, and, in particular, through institutional arbitration (ICC, ICSID) has become a frequent and Worldwide practice. This alternative sidetracks the filing, in national and international tribunals, of lawsuits that may otherwise take years to be heard.

The objective of this book's authors is to suggest means, to Contracting States and international investors alike, to improve current media of protection of investments made on foreign soil. Their suggestions are intended to facilitate the drafting of Treaty and State Contract texts better adapted to rapidly evolving international arbitration.

Biographie

Jan Schokkaert received his Doctor of Laws (J.D) degree from the Catholic University of Leuven (KUL), Belgium. His career in the service of the Belgian Ministry of Foreign Affairs, Foreign Commerce and Development Cooperation, led him to preside over the work of official Belgian and Luxembourg government delegations responsible for the preparation and negotiation with less developed countries of bilateral agreements for the protection of international investments (BIT's). He has also participated in international litigation between sovereign States.

Yvon Oscar Heckscher received his Doctor of Laws (J.D) degree from the University of California Law School, in Los Angeles, California. His Bachelor of Arts (Social Sciences) degree was awarded to him by Pepperdine University, California. He has also studied Law at the Free University of Brussels (ULB), Belgium. During his career in national defense industry, he was responsible for the preparation and negotiation of agreements for NATO procurement contracts and international corporate acquisitions. Later on, his lawfirm specialised in advice on US Immigration and Naturalisation laws, and on European Union sustainable Development laws and practices.
